01. Acceptance of Terms
By downloading, installing, accessing, or using the SettleGenie application and related services (collectively, the "Services"), you agree to be bound by these Terms & Conditions. This constitutes a legally binding agreement between you and BHUMAYA AI SOLUTIONS LLP ("Company," "we," "us," or "our").
If you do not agree to these terms, you must immediately cease all use of our Services and delete the application from your devices. Your continued use of the Services signifies your acceptance of any future modifications to these Terms.
02. Eligibility
You must be at least 18 years of age to create an account and use the Services independently. Individuals aged 13 to 17 may only use the Services with explicit permission and supervision from a parent or legal guardian who agrees to be bound by these Terms. We reserve the right to request proof of age at any time and may terminate accounts that fail to comply with these age restrictions.
03. Account & Security
When you register for an account, you agree to provide accurate, current, and complete information. You are solely responsible for:
- Maintaining the strict confidentiality of your login credentials.
- All activities that occur under your account, regardless of whether you authorized them.
- Immediately notifying us of any unauthorized use of your account or security breaches.
We will not be liable for any loss or damage arising from your failure to comply with these security obligations.
04. Subscriptions & Payments
While core features of SettleGenie may be free, we may offer premium subscription tiers or one-time purchases for advanced AI features, extended limits, or exclusive tools. All fees are stated within the application. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You authorize us (or our third-party payment processors) to charge your designated payment method for all applicable fees.
05. Cancellation & Refunds
You may cancel your subscription at any time through your device's app store settings or your SettleGenie account portal. Cancellation will take effect at the end of your current billing cycle. Payments are non-refundable, and we do not provide prorated refunds for partially used subscription periods, except where mandated by local consumer protection laws.
06. Data We Collect & How We Use It
Your privacy is important to us. Our collection and use of personal information, financial entries, and AI interaction data are governed by our Privacy Policy. By using SettleGenie, you consent to the processing of your data as outlined in that document. We do not sell your personal data to third parties.
07. Permissions We Request
To provide complete functionality, SettleGenie may request access to certain device features:
- Camera & Storage: Required for scanning receipts and setting profile pictures.
- Contacts: Optional, used solely to help you quickly add friends to expense groups.
- Notifications: Used to alert you about pending settlements, group updates, and AI trip generations.
You can manage these permissions at any time through your device operating system settings.
08. Acceptable Use
You agree not to use the Services in any way that is unlawful, harmful, or interferes with the platform's operation. You strictly agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the application.
- Use automated scripts, bots, or scrapers to interact with the Services or collect data.
- Attempt to circumvent our security measures or rate limits.
- Use the platform to facilitate money laundering, fraud, or illegal transactions.
09. Intellectual Property
All rights, titles, and interests in the Services—including software, designs, logos, trademarks, and proprietary algorithms—are the exclusive property of BHUMAYA AI SOLUTIONS LLP. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the app for personal, non-commercial purposes in accordance with these Terms.
10. AI-Powered Features
SettleGenie provides AI-generated content (e.g., automated trip itineraries, receipt parsing, budgeting advice). You acknowledge and agree that:
- AI-generated content is for informational purposes only and does not constitute professional financial, travel, or legal advice.
- Generative AI can produce inaccurate, incomplete, or outdated information ("hallucinations"). You must independently verify critical details such as prices, operating hours, and settlement calculations.
- We are not liable for any losses or damages incurred as a result of your reliance on AI-generated outputs.
11. Community Content & Guidelines
Our platform may include community features allowing users to post, share, or discuss content. By participating, you agree to adhere to the following guidelines:
11.1 User Ownership
You retain ownership of the original content you submit to the platform. However, by posting, you grant us the rights described in Section 11.8.
11.2 Prohibited Content
You may not post content that is illegal, defamatory, hateful, harassing, explicit, violent, or infringes upon the intellectual property rights of others. Spam, unauthorized advertising, and malicious links are strictly forbidden.
11.3 Content Moderation
We reserve the right, but assume no obligation, to monitor, review, and remove any user-generated content at our sole discretion without prior notice if we determine it violates these Terms.
11.4 User Reporting
Users are encouraged to report content that violates our guidelines using the in-app reporting tools. We aim to review reported content promptly.
11.5 Enforcement Actions
Violations of community guidelines may result in content removal, formal warnings, temporary feature restrictions, or permanent account termination, depending on the severity of the offense.
11.6 Appeal Process
If your content is removed or your account is restricted, you may submit an appeal to our support team within 14 days of the action. Appeals are reviewed on a case-by-case basis.
11.7 Content Liability
You are solely responsible for the content you post. We do not endorse user-generated content and specifically disclaim any liability associated with it.
11.8 License to Use Content
By posting public content, you grant BHUMAYA AI SOLUTIONS LLP a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute that content to operate and promote the Services.
11.9 Cooperation with Law Enforcement
We reserve the right to cooperate fully with any law enforcement authorities or court orders requesting the disclosure of identity or data related to anyone posting prohibited materials.
12. Third-Party Services
The Services may contain links to third-party websites or integrate with third-party tools (such as payment gateways or mapping services). We do not control these external services and are not responsible for their content, privacy policies, or reliability. Your use of third-party services is at your own risk.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHUMAYA AI SOLUTIONS LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to defend, indemnify, and hold harmless BHUMAYA AI SOLUTIONS LLP, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debts arising from: (i) your use of the Services; (ii) your violation of any term of these Terms & Conditions; or (iii) your violation of any third-party right, including copyright, property, or privacy right.
15. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. You may terminate your account at any time via the app settings.
16. Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Uttarakhand, India. We prefer to resolve issues amicably, so we encourage you to contact our support team before pursuing formal legal action.
